Terms of Service

1. Acceptance of Terms

By using iJeepney, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Description of Service

iJeepney is a real-time GPS tracking platform designed to connect jeepney drivers and passengers in Iligan City, Philippines. The App provides the following features:

• Enables drivers to share their real-time location with passengers during designated driving schedules
• Allows passengers to view nearby jeepneys, their routes, and real-time locations
• Permits passengers to optionally share their location with active drivers
• Displays route information and jeepney schedules
• Sends proximity notifications to drivers when passengers share their location

3. Eligibility and Age Requirements

Passengers: Users of all ages may use the passenger features of the App. Minors (individuals under 18 years of age) should use the App under the supervision of a parent or legal guardian.

Drivers: You must be at least 18 years old to register as a driver. By registering as a driver, you represent and warrant that you are at least 18 years of age and possess all necessary licenses and qualifications to operate a public utility jeepney in the Philippines.

4. Terms for Drivers

4.1 Driver Registration and Verification

By registering as a driver, you agree to provide accurate and complete information, including:

• Full legal name
• Valid email address
• Phone number
• Valid driver's license number

You acknowledge and agree that:

• Your registration is subject to verification and approval by iJeepney administrators
• Administrators may contact you via phone or email to verify your identity and driver credentials
• You authorize iJeepney to verify your submitted information with relevant authorities, operators, or regulatory bodies
• Providing false, misleading, fraudulent, or inaccurate information is grounds for immediate account termination and may result in being permanently banned from the platform
• You must promptly update your information if any details change

4.2 Driver-Jeepney Assignment and Scheduling

Jeepney information (including plate number, LTFRB number, and operator name) is managed by administrators, not by individual drivers. You understand and agree that:

• Administrators will assign you to specific jeepneys based on operator designation
• Administrators will create and manage your driving schedules, specifying which jeepney you will operate and at what date and time
• You may only share your location during your designated driving schedule for your assigned jeepney
• If you are not scheduled to drive or are outside your designated time slot, you will not be able to activate location sharing
• Multiple drivers may be assigned to operate the same jeepney at different times
• You may be assigned to different jeepneys on different dates

4.3 Data Collection and Public Visibility

By registering and using the App as a driver, you explicitly consent to the following:

Your phone number, email address, and driver's license number are NOT visible to passengers. Your location data is collected and displayed only while you actively share your location through the App during your designated schedule. Location sharing stops immediately when you close the App, stop sharing manually, or when your scheduled time ends.

4.4 Road Safety and Legal Compliance

You represent and warrant that:

• You possess all necessary licenses, permits, and certifications required to operate a public utility jeepney in the Philippines
• Your driver's license is valid and in good standing
• You have appropriate insurance coverage as required by law
• You will operate your vehicle safely and in accordance with all applicable laws
• You are solely responsible for the safe operation of your vehicle at all times
• You will only interact with the App when your vehicle is safely stopped or parked

4.5 Account Responsibility and Security

You are responsible for:

• Maintaining the confidentiality of your account credentials (email and password)
• All activity that occurs under your driver account
• Ensuring that no unauthorized persons use your account or device to access the App
• Not sharing your account credentials with any other person
• Notifying iJeepney immediately if you suspect unauthorized access to your account

4.6 Prohibited Conduct for Drivers

As a driver, you are strictly prohibited from:

• Providing false or misleading information during registration or at any time
• Operating the App or any mobile device while the vehicle is in motion
• Sharing your account with other drivers or allowing others to use your credentials
• Activating location sharing outside of your designated schedule
• Attempting to manipulate or falsify your location data
• Using the App in any manner that violates local, provincial, national, or international laws
• Harassing, threatening, or engaging in inappropriate conduct toward passengers or other users
• Attempting to access, modify, or interfere with the App's code, infrastructure, or data

4.7 Driver Account Deletion

You may request deletion of your driver account at any time through:

• In-app account settings
• The Data Deletion Request Form available on the Google Play Store listing
• Email request to quossettel@gmail.com

Upon account deletion, your personal information (name, email, phone, driver's license number) will be permanently removed from our active systems immediately. Jeepney records and schedules may be retained for operational purposes but will no longer be associated with your personal information. There is no data retention period—deletion is immediate and permanent.

5. Terms for Passengers

5.1 Anonymous Usage

Passengers may use the App completely anonymously without creating an account or providing any personal identifying information. You can view jeepney locations, routes, and schedules without logging in or registering.

5.2 Optional Location Sharing

You may choose to share your real-time GPS location with drivers. Location sharing is entirely optional and under your control. By sharing your location:

• Your real-time location becomes visible to drivers who are actively sharing their location
• Drivers receive a brief push notification when you start sharing your location in their vicinity
• Your location data is not stored or retained after you stop sharing
• You can stop sharing your location at any time by closing the App or disabling location sharing
• No other personal information is shared with drivers

5.3 Route and Schedule Information

You can view and filter jeepneys by route name and see route lines on the map. Route and schedule information is provided for informational purposes only. iJeepney is not responsible for schedule accuracy, delays, route changes, or service interruptions.

5.4 Prohibited Conduct for Passengers

You are strictly prohibited from:

• Using driver or jeepney location data to harass, stalk, threaten, intimidate, or harm drivers
• Attempting to identify or contact drivers for purposes unrelated to normal passenger-driver interactions during public transport operations
• Interfering with driver operations, safety, or schedules
• Attempting to manipulate or falsify your location data
• Using the App in any manner that violates applicable laws or regulations
• Attempting to access, modify, or interfere with the App's code, infrastructure, or data
• Using automated systems, bots, or scripts to access or interact with the App

6. General Provisions

6.1 Lawful Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not use the App in any way that violates any applicable local, provincial, national, or international law or regulation.

6.2 Third-Party Services

The App uses third-party services to provide functionality:

• Mapbox: For mapping, route display, and location services
• Firebase (Google): For authentication, real-time database, cloud storage, and analytics
• Vercel: For web hosting and application deployment

Your use of these services through our App is subject to their respective terms of service and privacy policies. We are not responsible for the practices, policies, or performance of these third-party service providers.

6.3 Limitation of Liability

WE ARE NOT LIABLE FOR:

• Traffic delays, missed rides, route changes, schedule variations, or service interruptions
• The conduct, actions, omissions, behavior, or decisions of any driver, passenger, or third party
• Any accidents, injuries, death, illness, property damage, or loss occurring during travel, commute, or while using the App
• The accuracy, reliability, completeness, or availability of GPS data, location information, or mapping services
• Data inaccuracies caused by GPS signal loss, poor internet connectivity, device limitations, or technical failures
• Any disputes, conflicts, disagreements, or interactions between drivers and passengers
• Violations of traffic laws, regulations, or safety standards by drivers
• The condition, safety, maintenance, or operation of any jeepney or vehicle
• Lost or stolen property
• Unauthorized access to or use of your device or account

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, IJEEPNEY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

6.4 Indemnification

You agree to indemnify, defend, and hold harmless iJeepney, its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses (including reasonable attorney's fees), or demands arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Any content or information you submit through the App
• Your conduct or interactions with other users

6.5 Service Availability and Modifications

We strive for 24/7 availability but do not guarantee that the App will be uninterrupted, timely, secure, or error-free. We reserve the right to:

• Suspend, modify, discontinue, or terminate the App or any features at any time with or without notice
• Perform maintenance, updates, or upgrades that may temporarily interrupt service
• Implement new features, change existing features, or remove features
• Change these Terms at any time

We will not be liable for any service interruptions, modifications, or discontinuation of the App.

6.6 Account Termination and Suspension

We reserve the right to suspend, disable, or terminate any account (particularly driver accounts) immediately and without prior notice if:

• You violate these Terms or our Privacy Policy
• You provide false, misleading, fraudulent, or inaccurate information
• You misuse location-sharing features or other App functionality
• You engage in conduct that we deem harmful, abusive, or dangerous to other users
• You violate any applicable laws or regulations
• We receive reports of misconduct or inappropriate behavior
• We are required to do so by law or legal process
• We determine that continued access poses a risk to the App, our systems, or other users

Termination of your account does not relieve you of any obligations or liabilities incurred prior to termination.

6.7 Intellectual Property Rights

All content, features, functionality, designs, logos, trademarks, software, and other materials in the App are the exclusive property of iJeepney or its licensors and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the App or any portion thereof without our express written permission.

6.8 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any disputes, claims, or controversies arising out of or relating to these Terms, the App, or your use of the App shall be subject to the exclusive jurisdiction of the appropriate courts of Iligan City, Philippines. You consent to the personal jurisdiction of such courts and waive any objection to venue.

6.9 Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Material changes will be communicated through:

• Updating the "Last Updated" date at the top of these Terms
• In-app notifications or banners
• Email notifications to registered drivers
• Prominent notice on our website

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically. If you do not agree to the modified Terms, you must discontinue use of the App immediately.

6.10 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

6.11 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iJeepney regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.

6.12 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of iJeepney.

6.13 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms at any time without restriction.
